These Terms of Service ("Terms") constitute an agreement between you and Palbuzzo, LLC ("Palbuzzo"), a Connecticut Company. The Terms govern your use of Palbuzzo's products and services ("Services"). By using the Services, you agree to be bound by these Terms. If you do not agree to the Terms, you cannot use the Services. Palbuzzo may update the Terms and its referenced documents at Palbuzzo's sole discretion at any time, and by continuing to use the Services after such updates you agree to be bound by the latest versions of the Terms and its referenced documents which will be posted on Palbuzzo's website. It is your responsibility to check for updates to the Terms and its referenced documents. If at any point you do not agree to, or are not able to agree to, the Terms, you must stop using the Services.
Depending on which of the Services you use, data may be collected as described in Palbuzzo's Privacy Policy. You consent to this collection of data according to the Privacy Policy and agree that you are of legal age, based on where you are located, to be able to consent to the collection of such data. For example, in some countries you must be at least 13 years of age to provide this consent, in other countries you must be at least 16 years of age to provide this consent, and other countries might have a different age requirement. In any case, if you are not at least 13 years old, you may not use the Services. Also, if any one of the Services is not allowed to be used from where you are located, you agree not to use it.
The Services contain original, copyrighted material created by Palbuzzo. You may not copy, distribute, modify, sell, lease, or profit in any way from such material without written consent from Palbuzzo. You may not reverse engineer or attempt to circumvent the normal operation of any software provided by Palbuzzo.
If you sign up to Palbuzzo's email notification subscription service ("Email Notifications Service"), you agree to receive emails from Palbuzzo which may contain promotional content regarding the latest news or offers from Palbuzzo. Palbuzzo may decide at its sole discretion the frequency of emails sent from the Email Notifications Service, however the frequency of promotional content sent from the Email Notifications Service will likely be one or two emails per month.
You agree that the email address you provide when signing up to the Email Notifications Service is an email address that only you have access to. You may stop using the Email Notifications Service at any time by following the unsubscribe process which is linked to in each email sent from the Email Notifications Service.
Some of the Services include software developed by Palbuzzo which Palbuzzo provides to you. Palbuzzo grants you a non-exclusive, worldwide, non-transferable, and limited license to use such software on your own device(s) in accordance with these Terms.
Due to export restrictions, any software provided by Palbuzzo may not be exported to any country to which the United States has embargoed goods, or to any national or resident of any such country. The software also may not be exported to anyone who has been prohibited from receiving exports by any federal agency of the United States Government. You represent and warrant that these restrictions do not apply to you, and that you will not violate these restrictions.
The software provided by Palbuzzo may contain advertisements, and network access may be used to download and display such advertisements. The software may also use network access to provide the Services to you or exchange information in accordance with Palbuzzo's Privacy Policy. Standard data rates may apply.
The Services may reference third party content by providing links to, or embedding resources from, third parties. Palbuzzo accepts no responsibility for such third party content. Palbuzzo accepts no responsibility for any losses or damages that may arise from your use of such third party content. By following such links to third parties or using such resources from third parties, you acknowledge that you do so entirely at your own risk and subject to any terms of use, privacy policies, and other policies such third parties may have.
The software provided by Palbuzzo may contain digital goods, such as in-app content, which can be purchased. If you choose to purchase such digital goods, you acknowledge that since the digital goods will be made available to you as soon as the purchase is complete, you waive any right to withdraw or cancel such purchases.
As a result, all such purchases are final. Refunds for purchases of digital goods made with real money will not be issued by Palbuzzo unless the digital goods are defective, in which case the refund must be requested within 48 hours of purchase. If you downloaded the software from Apple's App Store and need to request a refund in such a case, you must do so from the App Store. If you downloaded the software from the Google Play Store and need to request a refund in such a case, you can send an email to support@palbuzzo.com. Such refunds will be returned using the same method you used to make the payment.
The software provided by Palbuzzo may also contain virtual currency, such as virtual coins. Refunds will not be given for any purchases of digital goods that were made with virtual currency in any circumstance. You also agree that such virtual currency has no monetary value, and cannot be exchanged for real money, goods, or services.
Palbuzzo may decide at any time and at its sole discretion to stop providing any of the Services to any user, in whole or in part.
You agree that all communication between you and Palbuzzo will be in English. For support-related inquiries, please contact support@palbuzzo.com.
If you provide any feedback to Palbuzzo, it will be owned by Palbuzzo, and you agree that Palbuzzo can freely use such feedback without any restrictions.
You agree that these Terms shall be governed by the laws of the State of Connecticut, USA, without regard to its conflict of laws provisions. You agree that any suit arising from use of the Services must take place in a court located in Hartford County, Connecticut, USA. Should any provision in these Terms be unenforceable, that provision will be limited or removed to the minimum extent needed so that the rest of the provisions shall remain in full force and effect.
The Services are provided to you on an "as is" basis, without warranty of any kind. You agree that to the fullest extent permitted by law, Palbuzzo, its members, and employees will not be liable to you for any losses or damages caused in connection with the use of, or inability to use, the Services.
You agree to indemnify and hold Palbuzzo, its members, and employees harmless from any claim made by any third party arising from use of, or inability to use, the Services.
